General Terms and Conditions (GTC)

§1 Scope of Application

These General Terms and Conditions apply to the use of the Gundlach Carwash self-service car wash facility and all associated services and equipment.

This includes, but is not limited to:

  • Self-service wash bays

  • Vacuum stations

  • Floor mat cleaning machine

  • Coin exchange machine

  • Wash tokens

  • Customer cards / prepaid cards

  • Cashless payment systems

  • Vending machines

  • Other customer service facilities

By entering and using the facility, the customer accepts these Terms and Conditions.

§2 Use of the Facility

Use of the facility is at the customer's own risk.

Customers must follow all operating instructions, safety notices, warning signs and staff instructions.

The following activities are strictly prohibited:

  • Engine washing

  • Vehicle repairs

  • Oil changes

  • Washing of hazardous goods vehicles

  • Washing vehicles leaking fuel, oil or other operating fluids

  • Cleaning heavily contaminated vehicles with chemicals or hazardous substances

  • Disposal of waste, oil or chemicals

  • Intentional misuse or damage of equipment

The operator reserves the right to refuse service to any customer or vehicle.

§3 Vehicle Condition

Before using the facility, customers must ensure that their vehicle is suitable for washing.

In particular:

  • Windows and doors must be closed.

  • Loose parts must be secured.

  • Roof boxes and unsecured items must be removed.

  • Damaged attachments must be secured.

  • External antennas should be removed or secured.

The operator assumes no liability for damages resulting from the vehicle's condition.

§4 Customer Liability

Customers are liable for any damage caused by:

  • Incorrect operation

  • Improper use

  • Negligence

  • Intentional misconduct

  • Violation of these Terms and Conditions

This includes damage to:

  • Spray wands

  • High-pressure equipment

  • Hoses

  • Payment terminals

  • Coin changers

  • Vacuum cleaners

  • Buildings

  • Technical installations

§5 Operator Liability

The operator shall be fully liable only for damages caused by:

  • Intentional misconduct

  • Gross negligence

  • Injury to life, body or health

In cases of ordinary negligence, liability shall be limited to breaches of essential contractual obligations and restricted to foreseeable damages typical for the contract.

The operator shall not be liable for:

  • Existing vehicle damage

  • Paint defects existing before washing

  • Vehicle wraps and films

  • Loose vehicle parts

  • Previously damaged components

  • Antennas

  • Sensors

  • Cameras

  • Roof racks

  • Roof boxes

  • Decorative trim

  • Age-related material fatigue

§6 Wash Tokens

Wash tokens may only be used for services offered at the facility.

Cash redemption of wash tokens is excluded.

Lost wash tokens will not be replaced.

The operator reserves the right to replace wash tokens with alternative payment systems for technical or operational reasons.

§7 Customer Cards (Prepaid Cards)

Rechargeable customer cards may be offered for use at the facility.

Customer cards may be loaded with credit and used at designated payment terminals.

The following information may be stored:

  • Card number

  • Credit balance

  • Recharge transactions

  • Usage transactions

  • Payment records

Unregistered cards cannot be replaced if lost.

Registered cards may be blocked and any remaining balance transferred to a replacement card after verification.

Fraudulent use or manipulation attempts may result in immediate card suspension.

§8 Business Customer Cards

Business customers may receive special customer cards or invoicing solutions.

Billing is based on recorded usage data.

Any objections to invoices must be submitted in writing within 14 days of receipt.

§9 Payment Methods

The facility may offer payment via:

  • Wash tokens

  • Cash

  • Coins

  • Banknotes

  • EC cards

  • Debit cards

  • Credit cards

  • Customer cards

The payment methods available depend on the equipment installed at the facility.

§10 Payment Service Providers

Card payments may be processed by third-party payment service providers.

The operator accepts no responsibility for failures or interruptions caused by:

  • Banks

  • Payment processors

  • Card networks

  • Mobile networks

  • Internet providers

This applies in particular to systems operated by:

  • PAYONE

  • Nayax

No compensation claims may be made for service interruptions beyond the operator’s control.

§11 Complaints and Refunds

Technical malfunctions or incorrect charges must be reported without undue delay.

Customers should provide:

  • Date

  • Time

  • Wash bay number

  • Card number (if applicable)

  • Payment method used

Following review, justified claims may be resolved through:

  • Credit reimbursement

  • Bonus credit

  • Refund

Cash refunds shall only be granted where legally required.

§12 Operational Interruptions

The operator may temporarily close or restrict operation of the facility.

This may occur due to:

  • Maintenance

  • Repairs

  • Frost conditions

  • Power outages

  • Water supply interruptions

  • Technical failures

  • Force majeure events

Such interruptions do not entitle customers to compensation.

§13 Winter Operations

During periods of frost, snow or ice, certain functions or parts of the facility may be temporarily disabled for safety and operational reasons.

The operator alone determines the extent and duration of such restrictions.

§14 Opening Hours

The facility may only be used during published opening hours.

Current opening hours:

Monday to Saturday
06:00 AM – 10:00 PM

The operator reserves the right to change opening hours at any time.

§15 House Rules

The operator exercises householder rights throughout the property.

Customers may be excluded from the premises for:

  • Violating these Terms and Conditions

  • Harassing other customers

  • Damaging property

  • Improper use of equipment

  • Dangerous conduct

§16 Video Surveillance

Where video surveillance is installed, it is used for:

  • Protection of customers

  • Protection of employees

  • Protection of technical equipment

  • Protection against vandalism and theft

  • Investigation of criminal offences

Any processing of personal data is carried out in accordance with applicable data protection laws.

§17 Vending Machines

Products sold through vending machines are subject to the applicable statutory warranty rights.

Any visible defects must be reported immediately.

§18 DHL Parcel Locker

Any DHL parcel locker located on the premises is operated exclusively by DHL.

The operator assumes no responsibility for:

  • Deliveries

  • Shipments

  • Delivery delays

  • Technical faults

  • User errors

  • Availability of DHL services

All claims relating to DHL services must be addressed directly to DHL.

§19 Governing Law and Jurisdiction

These Terms and Conditions shall be governed exclusively by the laws of the Federal Republic of Germany.

If the customer is a merchant, public-law entity or special public-law fund, the place of jurisdiction shall be Neuwied, Germany.

§20 Severability Clause

Should any provision of these Terms and Conditions be wholly or partially invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.

The invalid provision shall be replaced by a legally permissible provision that most closely reflects the economic purpose of the original provision.
